Terms of Service

The Agency Directory is operated by Ahrefs Pte. Ltd. located at 16 Raffles Quay #33-03, Hong Leong Building, Singapore 048581. These Agency Directory Terms and Conditions (“Terms”) apply to your use of the Agency Directory, whether you are a Service Provider or a Client. By accessing or using the Agency Directory you agree to be bound by these Terms. Be sure to return to this page periodically to review the most current version of the Terms. We reserve the right at any time, at our sole discretion, to change or otherwise modify the Terms without prior notice, and your continued access to or use of the Services signifies your acceptance of the updated or modified Terms. We retain the right, at our sole discretion, to deny access to the Agency Directory to anyone, at any time and for any reason, including, but not limited to, for violation of these Terms.

Definitions

“Agency Directory” means the online platform that Ahrefs makes available on the Agency Directory Website that lists the Service Providers that may offer their Agency Services. “Agency Directory Website” means Ahrefs’ Agency Directory web page located at https://liftbodyfocus.vip/agencies%3C/a%3E%3C%21-- -->.
“Agency Services” means the services offered by Service Providers on the Agency Directory. “Service Provider” means a marketing agency or other provider of marketing services that lists its Agency Services on the Agency Directory. “Client” means the individual or entity that accesses the Agency Directory for the purposes of using Agency Services offered by Service Providers. “Ahrefs”, “we”, “us” or “our” means Ahrefs Pte. Ltd. located at 16 Raffles Quay #33-03, Hong Leong Building, Singapore 048581. “You” or “your” refers to the person or entity using the Agency Directory, whether as a Service Provider or Client. “User Content”, means all content, including without limitation, language, data, information, and images, provided through use of the Agency Directory, whether by us, Service Providers, or other users of the Agency Directory.

Account registration

In order to list and provide Agency Services on the Agency Directory you must register as a user of Ahrefs’ Service and have an Advanced or Enterprise plan. Your plan must remain active and kept in good standing. Your use of the Ahrefs’ Services shall at all times be subject to the current Ahrefs Terms and Conditions available at https://liftbodyfocus.vip/terms%3C/a%3E%3C%21-- -->.

Your use of the platform

As a condition of your use of the Agency Directory, you agree that you will comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, tax laws, and regulatory requirements. You also agree that you will not:

  • copy, reproduce, download, re-publish, sell, distribute or resell any services, content, or information found on the Agency Directory Website ("Site Content") excluding User Content submitted by you;

  • copy, reproduce, download, compile or otherwise use any Site Content for the purposes of operating a business that competes with the Agency Directory or otherwise commercially exploit the Site Content;

  • use manual or automated software, devices, scripts, robots, other means or processes to systematically retrieve any Site Content from the Agency Directory Website;

  • use any content or materials available on or through the Agency Directory Website for any purpose not expressly permitted in these Terms;

  • remove or modify any copyright, trademark, or other proprietary rights notices that appear on the the Agency Directory;

  • submit or otherwise make available any content that:

    • is confidential, proprietary or discloses sensitive information;

    • discloses or solicits the private information of any person or business;

    • is invasive of any person or business privacy or otherwise violates any person or business legal rights;

    • is deceptive, false, misleading or fraudulent;

    • is threatening, abusive, harassing, stalking, or defamatory;

    • infringes a third party's intellectual property rights;

    • distributes any software, music, videos, or other material protected by intellectual property laws or by rights of privacy or publicity unless you have all necessary rights and consents to do so;

    • contains viruses, corrupted files, or any other similar software or programs that may damage the operation of another person's computer;

    • downloads any file that you know, or reasonably should know, cannot be legally distributed in that way;

    • falsifies or deletes any author attributions, legal or proprietary designations, labels of the origin or source of software, or other material contained in a file that is uploaded;

    • harvests or otherwise collects information about others, including email addresses, without their consent;

    • damages, disables, overburdens, or impairs any Ahrefs website;

    • is in violation of any applicable law or regulation.

User Content

Our use of the User Content

When you submit any User Content on or through your use of the Agency Directory you grant to us all rights, licenses, and permissions necessary to display, reproduce, disseminate, and otherwise use this User Content in connection with the Agency Directory. We may edit or remove the User Content at any time at our sole discretion if such User Content is not compliant with these Terms.

Your responsibility for the User Content you submit

You acknowledge and agree that you are solely responsible for all the User Content you submit. You agree that you have all required rights to share such User Content with us for our use and with other users of the Agency Directory without violating any third party rights or intellectual property laws. You assume all risks for any User Content you submit, including Client’s reliance upon such User Content. You may expose yourself to liability if you submit User Content that is false, misleading, defamatory, violates any third party right or contractual restriction or contains unlawful material. You agree that you will indemnify, defend, and hold us harmless, at your expense, for all claims resulting from User Content that you submit. We will notify you in writing within thirty (30) days of our becoming aware of any such claim; give you sole control of the defense or settlement of such a claim; and provide you (at your expense) with any and all information and assistance reasonably requested by you to handle the defense or settlement of the claim. You further acknowledge and agree that we reserve the right, in our sole discretion, to reject, edit, or remove any User Content that is contributed to the Agency Directory for any reason or no reason, but we do not assume the obligation.

Your risk in using User Content

You acknowledge and agree that we do not verify, adopt, ratify, or sanction any User Content and that you must evaluate and bear all risks associated with your use of or reliance on such User Content. Reference to any products, services, processes or other information, by trade name, trademark, manufacturer, supplier or otherwise and any ranking on the Agency Directory does not constitute or imply endorsement or recommendation thereof by Ahrefs. User Content and rankings consist of the opinions of third parties and may contain inaccuracies. Ahrefs makes no assurances regarding the quality, accuracy, or reliability of any User Content or rankings on the Agency Directory.

Ownership and intellectual property

As between you and Ahrefs, you own the User Content you submit. Ahrefs owns all content other than User Content. The Agency Directory is protected by copyright, trademark, and other laws of Singapore and foreign countries. Except as expressly provided in these Terms, Ahrefs exclusively owns all rights, title and interest in and to the Agency Directory, including all associated intellectual property rights. All trademarks, service marks, logos, trade names and any other proprietary designations of Ahrefs are the trademarks or registered trademarks of Ahrefs and may not be copied, imitated or used, in whole or in part, without the prior written permission of Ahrefs. All other trademarks, registered trademarks, product names and company names or logos mentioned in the Agency Directory are the property of their respective owners.

Modifications to the Agency Directory

We are constantly changing and improving our services. We may modify the Agency Directory or any part thereof at any time, and we may suspend or discontinue the Agency Directory altogether. We may also stop providing the Service to you at any time and for any reason, including, but not limited to, for violation of these Terms. You agree that Ahrefs shall not be liable, to you or to any third party, for any modification, suspension or discontinuance of the Agency Directory.

Liability for our service

The Service and all information provided therein are on an "as is" and "as available" basis without any warranty. TO THE EXTENT PERMITTED BY LAW, AHREFS, WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF AHREFS, FOR ANY CLAIM UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT YOU PAID US TO USE THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM (OR, IF WE CHOOSE, TO SUPPLYING YOU THE SERVICE AGAIN). TO THE EXTENT PERMITTED BY LAW, AHREFS, WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.
